Data Theft

   It is consult within Section 43(b) of the IT Act. It covers three expressions -- download, copying and extraction. Whoever "downloads, copies or extracts any data, computer database or information from a computer, computer system or computer network including information or data held or stored in any removable storage medium" without permission of the owner or any other person in charge shall be liable to pay damages. The owner has an exclusive digital content rights of reproduction.

    If the act is done dishonestly or fraudulently, the wrongdoer can be imprisoned for a term which may extend to three years or fine which may extend to Rupees 5 lakh or both (u/s 66)

    Section 43 A makes a body corporate liable to pay compensation in case they fail to protect data. In today's world where large files can be transmitted via email, USB devices etc, data theft is a growing concern that needs to be tackled in right earnest.
